1. Website Design Services
1.1 Introduction
This section outlines the terms for our Creative Services Agreement, which establishes the scope of work for professional website development.
1.2 Project Scope & Deliverables
Our website design services typically cover the development of business informational sites (e.g., 7-10 pages), including top-level pages, landing pages, supporting inner pages, AI-assisted content development, and multilingual functionality. The project process is structured into production sprints, with phases focusing on understanding needs, asset collection, site structure development, mock-ups, feedback incorporation, content development, technical implementation, and final deployment.
1.3 Content Development & Technical Implementation
Our service includes AI-assisted content development for professional web copy (initial development and one round of edits), placeholder visual assets, and content strategy guidance. Technical implementation typically includes custom theme design, modern styling, image processing, icon integration, page development within the agreed scope, CSS coding, plugin configuration, navigation menus, Google font typography, and basic SEO.
1.4 Client Responsibilities
To ensure a smooth project, you are responsible for providing business logo files, brand guidelines (if available), high-quality photographs or approval for stock imagery, timely feedback during review periods, content direction and approval, and translation content (if multilingual features are used).
1.5 Payment Terms & Refunds for Website Design Services
Payment for website design projects follows a milestone-based schedule. Initial payments are due at project start, with subsequent payments upon completion of feedback reviews for each production sprint. Client delays in providing feedback or content may extend the project timeline but will not affect the payment schedule for completed work. Given the project-based, milestone payment structure, payments made for completed phases or services are generally non-refundable, reflecting the work and resources already expended.
2. Website Care Subscription Service
2.1 Service Overview
Our Website Care Service provides continuous support for your business online. We offer Standard and Premium plans designed to provide responsive support for your WordPress site.
2.2 Included Services
Our Website Care plans include:
Managed Website: Monitoring your website’s online health, identifying and fixing issues arising from theme and plugin updates.
Support: Online video support (Loom), Search Console monitoring (Google, Bing), domain and DNS support, and CloudFlare management.
Ad-hoc Services: These are for changes, improvements, general webpage edits, content optimization, and creating additional pages. For Premium subscribers, additional services include consultations, design & development implementations, page speed optimization, and email account support.
2.3 Ad-Hoc Hours Policy
The ad-hoc hours included in our plans are a measurement of fairness for the level of support provided. They are not intended to be “banked” or explicitly used up in a strict hourly sense. The fee covers premium support, direct contact via messenger and email, and a dedicated team member to handle your requests, saving time and money by providing consistent instruction and addressing needs. While we track requests internally to balance workload over time, we do not provide monthly reports on these hours, as this service model is designed for efficient, continuous support rather than detailed hourly billing typical of larger marketing budgets.
2.4 Website Care Subscription Refund and Cancellation Policy
Cancellation: You may cancel your Website Care subscription at any time. You can manage your subscription and payment details, including cancellation, through the customer billing portal, or you can inform us directly, and we will process the cancellation for you.
Refunds: A full refund for your Website Care subscription will be issued if you cancel within seven (7) days after the charge date. After this 7-day period, the fee for the current subscription period is considered earned and is non-refundable. All monthly plans are auto-recurring subscriptions, billed via Stripe.
3. General Terms
3.1 Acceptance of Terms
By accessing or using any part of our services, you agree to become bound by these Terms.
3.2 Intellectual Property
This Agreement does not transfer any OPTe or third-party intellectual property to you. All rights, title, and interest in such property remain solely with OPTe.
3.3 Limitation of Liability
OPTe disclaims responsibility for any harm resulting from your use of the website or content posted. In cases of termination, OPTe will have no obligation to provide a refund of any amounts previously paid.
3.4 Governing Law
These Terms shall be governed by and construed in accordance with the laws of New York, United States of America.
3.5 Changes to Terms
We reserve the right to update these Terms periodically. We will notify you of any material changes by posting on our blog or sending an email before the changes take effect. Your continued use of our services after the new Terms take effect will constitute your acceptance of those changes.
